Mobi PCS Privacy Policy

This Privacy Policy ("Policy") applies to customers who purchase and/or use our services and products in the United States. Mobi PCS may revise and update this Policy, with or without notice, if there are any changes in our practices or in the law. Customers are encouraged to regularly review the most current version of our Policy on our website at www.mobipcs.com.

How we Use your Personal Information

Information You Give Us
Mobi PCS collects personal information when you purchase a Mobi PCS product or use one of our services. For example, you may provide us personal information like your name and date-of-birth when subscribing to service. Or, you may provide us with your credit card number, social security number or bank account information if you initiate automatic payment. Any information you give to us will be used in accordance with this Policy. We do not sell or disclose your personal information to unaffiliated third parties.

We may use your personal information to inform you about new products and services from Mobi PCS that we think may be of interest to you. Mobi PCS may from time to time contact you using your mobile phone's text messaging service or by phone, mailers (to your residence or business), voicemail or email to inform you about our new products, services and upgrades. If you prefer to hear about new products by email rather than by phone or mailers, you may specify how you prefer to hear from us, in which case we will try to honor that request. Certain text messages sent to you through your phone may give you the opportunity to opt-out of such messages in the future. Remember, however, that you will still receive important customer service text messages and notices as to changes to any of our policies even if you opt-out of receiving information relating to products and services. Mobi PCS may also sell a service where the customer purchases a text messaging package from our promotional partners offering discounts on products and services. If a customer purchases this optional service you will receive promotional text messages for the duration of the service. At no time does Mobi PCS market or advertise via phone, mailers, email or text messaging strictly for the benefit of other companies or unrelated service and product providers.

Mobi PCS occasionally uses your personal information to provide important notices to you. For example, Mobi PCS sends monthly text messages to remind our customers that additional pre-payment is due for the upcoming month of service. If you use our automatic payment service, then you generally will not receive a monthly payment reminder. Mobi PCS also sends text messages to update customers as to changes to this Policy or to the Terms and Conditions of Service. The customer is responsible for reading and understanding customer service related notices sent through your mobile phone.

Sensitive personal information such as your credit card number, social security number and bank account information are kept confidential. Sensitive personal information is for internal business use only and is disclosed to business partners only to the extent necessary to complete a transaction or to perform a service requested by the customer. For example, downloads for ring tones and wallpaper may be provided by a business partner. Your credit card information is shared with the business partner to complete and collect payment from you in the event you pay by credit card.

Automatically Collected Information
Mobi PCS automatically receives certain types of personal information when you interact with our Web site. For example, our systems collect your computer IP address and the type of browser you use. Our Web site places small files, known as cookies, on your computer's hard drive when you visit so that when you return to the site, the site knows who you are and can personalize your visit. The information collected from the use of cookies is used only to improve our site, to complete transactions you have requested and to make product or service recommendations. Our Web site may also use a Web beacon, a small, graphic image on a Web page, that collects the IP address of the computer to which the Web beacon is sent, the URL page from which the Web beacon comes and the time it was viewed. Web beacons, as with cookies, are used only for the purpose of improving service to the customer.

If you dial 9-1-1 for emergency service, our network knows the approximate location of your phone. This information may be shared with emergency service providers, law enforcement officials and health care facilities.

Information From Outside Sources
Mobi PCS may collect commercially available marketing information about you from third parties and use that information together with the personal information you provide to us. Mobi PCS collects this information to better serve you and to inform you about new products and services that we believe may be of interest to you based on your likes and preferences. As with other personal information collected by Mobi PCS, commercial marketing information that we collect about you will only be used in connection with your mobile service.

Customer Proprietary Network Information ("CPNI")
There is a special category of personal information known as CPNI that is regulated under federal law. CPNI is information that Mobi PCS obtains or creates when it provides mobile wireless telecommunications services to a customer. CPNI includes such information as call records, rate plans and billing details. Mobi PCS may use your CPNI to provide and market mobile phone services to you based on your phone usage and rate plan. You may be able to opt-out of our using CPNI for this purpose. Your CPNI is not disclosed to third parties unless required by law. CPNI may be disclosed to an affiliate of Mobi PCS for the purpose of marketing communications related services to you, but Mobi PCS provides sufficient information to enable you to make an informed decision as to whether you want CPNI used in this manner before sharing the information. Mobi PCS follows your directions if you choose not to allow us to share your information with an affiliate. Mobi PCS limits the use of the personal information provided to an affiliate to the purpose for which the information was sent.

Other Disclosures
There are times when Mobi PCS is under an obligation to disclose your personal information. First, disclosure of your personal information may be required by law or in good-faith reliance on legal process, or in connection with various regulatory filings. For example, Mobi PCS discloses personal information to comply with court orders or subpoenas. Second, personal information may be disclosed to protect Mobi PCS, its users, its affiliates and business partners from fraudulent, abusive, or unlawful use of any service or product. Finally, subject to technological limitations, it is possible Mobi PCS may disclose a customer's approximate location and identity if we reasonably believe that an emergency involving immediate danger of death or serious physical injury requires notice to a governmental entity without delay.

Services and Products Offered by Other Companies
A customer may purchase services or products from another company that is utilizing our wireless service. The use of personal information provided in connection with the purchase of a product or service from another company utilizing our wireless service is governed by that company's privacy policy, and not ours. For example, if you are roaming on the network of another carrier, information about your location and the numbers you dial will be available to the other carrier and governed by that carrier's privacy policy. Mobi PCS users are advised to review the privacy policy of other companies from whom services or products are requested.

We Protect your Personal Information

Web site Security
Mobi PCS maintains safeguards to protect personal information provided through our Web site. When you log on to our Web site, order a service or product or make a payment online, Mobi PCS employs encryption technology, such as Secure Sockets Layer ("SSL") to protect your account information. While no security system is utterly fail-proof, Mobi PCS endeavors to provide Web site resources that are free from third party interference.

Mobile Phone Security
Mobi PCS implements systems in our network that are designed to prevent interception of your communications by third parties. Mobi PCS systems also block and reduce unsolicited bulk text and Short Messages ("SMS"). Mobi PCS uses a Synaverse provided third party clearing house for screening and filtering network originated SMS. There is no automated SMS entry point that does not have to pass through the bulk message prevention software. The goal is to keep your phone and the use of your phone free from intrusion. Although there is no absolute way to protect your phone from third party interference, our systems assure reasonable safeguards to your privacy while using Mobi PCS services and phones.

Mobi PCS Employees and Agents
All Mobi PCS employees and agents are responsible for safeguarding individual customer communications and information. All employees and agents are required to comply with this Policy. Customer accounts, records and reports are accessed for authorized business purposes only. The sharing of personal information with any third party without customer consent is strictly prohibited.

Updating this Policy
Mobi PCS may revise and update this Policy, with or without notice, as it deems appropriate to comply with changing practices or law. It is the customer's responsibility to refer back to this Policy for updates and changes.
